Zimmerman lawyer starts social media effort

George Zimmerman's attorney has launched?an all-out social media campaign?on behalf of his client, accused of second-degree murder in the killing of Trayvon Martin.

That social media effort includes a?Facebook page, a website and a Twitter account on behalf of Zimmerman.

"We understand that it is unusual for a legal defense to maintain a social media presence on behalf of a defendant, but we also acknowledge that this is a very unusual case," says Zimmerman attorney Mark O'Mara on the new site, George Zimmerman Legal Case.?

The?American Bar Association's standards of?professional conduct does not deal with social media, a spokesman for the ABA told msnbc.com, but "it's certainly going to be on everyone's radar screen" now.

Stephen A. Saltzburg, a member of the ABA's governing body, the House of Delegates, and former chairman of the ABA's?criminal justice section, said?"generally speaking, lawyers are not supposed to be making public statements that could compromise a fair trial."?

Whether the Zimmerman social media effort will do that would be up to a judge, Saltzburg said.

"Social media is kind of a new thing. I suspect?judges in highly publicized cases are going to think about trying to order lawyers and defendants to stay away from social media in order not to taint the jury pool."

Zimmerman started his own website, "The Real George Zimmerman," April 9, two days before he was arrested and charged with Martin's murder. In the two weeks the site was up, Zimmerman?raised $204,000 before O'Mara shut that site down.

O'Mara said last week?that money now?has been put into an account?that can't be accessed directly by Zimmerman or his family.

"We have worked to shut down all of Mr. Zimmerman?s websites and social profiles," O'Mara said on the new site. "It is not in Mr. Zimmerman?s best interests to speak publicly about this case, and as he has hired us to represent him, we feel part of our responsibility to our client is to provide a voice for Mr. Zimmerman, but only when it is appropriate to do so."

The attorney said on the new site he understands and acknowledges "the criticism that this is an opportunistic move using the event of a tragedy for personal or firm gain. Rest assured, that if the controversy surrounding this matter subsided tomorrow, so would our efforts to address the perceived problems the way we feel is necessary."

But social media, he said, cannot be ignored "in this day and age ...?It is now a critical part of presidential politics, it has been part of revolutions in the Middle East, and it is going to be an unavoidable part of high-profile legal cases, just as traditional media has been and continues to be. We feel it would be irresponsible to ignore the robust online conversation, and we feel equally as strong about establishing a professional, responsible, and ethical approach to new media."

The defense team hopes to disrupt "misinformation" about the case, which they believe is rife. "There is a tremendous volume of conversation on the Internet regarding news about this case. Some of it is based on fact; some is opinion and speculation; some is rumor; and some is malicious misinformation. We are in a position to distinguish (when appropriate) fact from the rest," O'Mara said on the site.?

But some would say the defense is not in a position to distinguish fact "from the rest," as it is not the judge or the jury.?

O'Mara also?made clear on the website that the defense team "cannot and will not comment about the facts of the case, as that is the purpose of the courts and legal process. Part of our presence online is to discourage public speculation about the facts of the case."

How the defense will both distinguish the facts of the case without commenting on those facts may be quite tricky.?We tried reaching O'Mara at his office, and will update this story if we hear back.

The Facebook page, George Zimmerman Legal Case, shows a photo of a cozy-looking house. (It's not Zimmerman's; it's O'Mara's office in Orlando, Fla.)?

On the page, people are welcome to comment about the case, but, said O'Mara, "we have?begun removing posts that we feel are inappropriate, and if you find your post has disappeared, it is likely for one of the following reasons." Among them: "profane and/or racially charged language," "speculation about the facts?of the case which must and will only be discussed in a court of law," "aggressively disparaging or unfairly critical of people associated with the case," and perhaps chillingly, those that "contained a threat."

"We will not remove posts simply because they are critical of George Zimmerman or his legal defense," O'Mara says on the page.

A Twitter?account, GZlegalCase, is also up and running; a legal defense fund website is in the works.?

"We do intend to raise funds on behalf of our client, and when we are approved to do so, we will accept funds online," O'Mara said on the George Zimmerman Legal Case site. "We understand that this is controversial, but Mr. Zimmerman deserves a fair trial, and mounting a defense is an expensive proposition."

NJIT Distinguished Professor of Chemical Engineering Kamalesh K. Sirkar was awarded a patent today for his water desalination technology. "Desalination Devices and Systems Using Porous Hydrophobic Hollow Fibers and Hydrophobic Porous Coatings" (US Patent Number 8,167,143) discloses membrane devices and methods for direct contact membrane distillation and vacuum membrane. Sirkar is Foundation Professor in Membrane Separations at NJIT's Newark College of Engineering http://chemicaleng.njit.edu/.

These devices and systems can recover a larger fraction of water from brine than reverse osmosis, the current industry standard for water desalination. In his research and pilot plant studies, Sirkar has achieved extraordinarily high water vapor fluxes and stable performances from brines with salt concentrations of over 20 percent. Reverse osmosis as currently practiced for seawater desalination does not work when salt content exceeds 6 percent.

This technology has been used successfully to treat sea water collected near the discharge from a nuclear power plant and liquid animal wastes. Additional investigations on other systems are ongoing. The design is robust in terms of handling scaling salts. Membrane distillation can utilize waste heat from a variety of sources, prevent thermal pollution and operate at essentially atmospheric pressure.

Membrane separation processes are used throughout the world by the chemical, food, petrochemical, pharmaceutical and biotechnology industries to separate purify or concentrate liquid solutions, cellular suspensions or gaseous mixtures. They are also increasingly important in meeting the growing global need for pure drinking water, an application that has been a major focus of Sirkar's recent research at NJIT. NJIT is also the lead site of the National Science Foundation (NSF) Industry/University Cooperative Research Center (I/UCRC) http://www.nsf.gov/eng/iip/iucrc/ for Membrane Science, Engineering and Technology. The other site is at the University of Colorado, Boulder.

Sirkar is the author of 165 refereed journal articles and 19 book chapters, and is a co-editor of the widely used Membrane Handbook. He has also served as the editor of the Elsevier series Membrane Science and Technology and as an associate editor of Separation Science and Technology. He has served (or is serving) on the editorial boards of the Journal of Membrane Science, Industrial and Engineering Chemistry Research, and Separation Science and Technology. He is the inventor or co-inventor of 28 US patents.

A Fellow of the American Association for the Advancement of Science, Sirkar's many awards and honors include: NJIT 2009 Overseer's Research Award; Clarence Gerhold Award of the Separations Division of AIChE (2008); the AIChE Institute Award for Excellence in Industrial Gases Technology (2005); and direct mention of him in the Kirkpatrick Award to Hoechst Celanese for his invention of membrane solvent extraction (1991). He is an Honorary Fellow of the Indian Institute of Chemical Engineers.

Smartphones: Is Apple or Samsung No. 1?

Smartphones sales are clearly reported by Apple. But Samsung remains very vague about how many smartphones it makes.

Smartphones?are the hottest gadgets in the world. But who's the biggest?smartphonemaker? We don't really know.

Samsung, Apple's chief competitor, gives only vague indications of how many it makes, which means industry watchers come up with widely diverging estimates. Apple Inc. reports its iPhone sales down to the thousands. In the January to March period, it shipped 35,064,000. South Korea's Samsung Electronics Co. may have sold 32 million, 37.5 million or 44.5 million, depending which analyst you believe. The company itself refuses to say.

What's at stake, of course, are bragging rights. More accurate sales figures from Samsung would also be useful to competitors and to partners like wireless carriers and retailers.

When it reported first-quarter results Friday morning, Samsung said only that overall phone shipments (including "dumb" phones) were down more than 10 percent from the fourth quarter, and that?smartphonesales were about the same percentage of the company's overall sales as they have been before.

The problem is that Samsung hasn't reported any hard sales figures in a long time, so analysts are applying these vague hints to their own estimates, which in turn are based on vague hints from previous quarters.

There's even a debate about what Samsung's few guideposts really mean. Jan Dawson, an analyst at Ovum, says the analyst community is split over the interpretation of Samsung's reported "300 percent" increase insmartphone?sales in the third quarter of 2011, over the third quarter of 2010. A 300 percent increase means a quadrupling, but did Samsung really mean that? Or did sales triple, and they made the common mistake of calling that a "300 percent increase?"

The two schools of thought account for some of the widely diverging estimates, Dawson believes. Analysts and reporters haven't been able to get Samsung to clarify the issue.

Wayne Lam, an analyst with IHS iSuppli, likens the process of estimating Samsung sales to "using compasses instead of GPS." His estimate for first-quarter?smartphone?sales is 32 million, which would put Samsung behind Apple.

IDC Corp., a research firm that tracks phone sales, postponed the release of its quarterly phone sales ranking. It was originally scheduled for just after Samsung's report, but analyst Ramon Llamas said "additional insight" was needed.

Analysts agree that in terms of overall phone sales, including non-smart ones, Samsung outdid long-time No. 1 Nokia Corp. in the first quarter. But they differ on the margin of victory. Finland's Nokia said it sold 82.7 million phones. ABI Research's Michael Morgan puts Samsung at 83.4 million, only just ahead. Strategy Analytics has it at 93.5 million.

The estimates differ by 10.1 million phones, roughly enough for all the adults in New York, Los Angeles and Chicago.

Samsung is not alone in espousing vagueness. Taiwan-based?smartphone?maker HTC Corp. recently stopped reporting how many phones it makes, possibly because its sales are in decline.

"The bottom line is Samsung and Apple are definitely consolidating at the top," Lam said. "The lead will trade back and forth a bit."

(AP) ? New research sends a stark warning to overweight teens: If you develop diabetes, you'll have a very tough time keeping it under control.

A major study, released Sunday, tested several ways to manage blood sugar in teens newly diagnosed with diabetes and found that nearly half of them failed within a few years and 1 in 5 suffered serious complications. The results spell trouble for a nation facing rising rates of "diabesity" ? Type 2 diabetes brought on by obesity.

The federally funded study is the largest look yet at how to treat diabetes in teens. Earlier studies mostly have been in adults, and most diabetes drugs aren't even approved for youths. The message is clear: Prevention is everything.

"Don't get diabetes in the first place," said Dr. Phil Zeitler of the University of Colorado Denver, one of the study leaders.

A third of American children and teens are overweight or obese. They are at higher risk of developing Type 2 diabetes, in which the body can't make enough insulin or use what it does make to process sugar from food. Until the obesity epidemic, doctors rarely saw children with Type 2 diabetes. The more common kind of diabetes in children is Type 1, which used to be called juvenile diabetes.

Doctors usually start Type 2 treatment with metformin, a pill to lower blood sugar. If it still can't be controlled, other drugs and daily insulin shots may be needed. The longer blood sugar runs rampant, the greater the risk of suffering vision loss, nerve damage, kidney failure, limb amputation ? even heart attacks and strokes.

The goal of the study was simple: What's the best way for teens to keep diabetes in check?

The study involved 699 overweight and obese teens recently diagnosed with diabetes. All had their blood sugar normalized with metformin, then were given one of three treatments to try to maintain that control: metformin alone, metformin plus diet and exercise counseling, or metformin plus a second drug, Avandia.

After nearly four years, half in the metformin group failed to maintain blood sugar control. The odds were a little better for the group that took two drugs but not much different for those in the lifestyle group.

Even so, Zeitler said doctors would not recommend this combination drug therapy because Avandia has been linked to higher risk of heart attacks in adults. Those risks became known after this study had started.

Another study leader from Children's Hospital Los Angeles, Dr. Mitchell Geffner, agreed that Avandia can't be recommended for teens, but said the study makes clear they will need more than metformin to control their disease.

"A single pill or single approach is not going to get the job done," he said.

Among all the teens in the study, 1 in 5 had a serious complication such as very high blood sugar, usually landing them in the hospital.

The results were published online Sunday by the New England Journal of Medicine and presented at a pediatric meeting in Boston. The National Institutes of Health funded the study and drug companies donated the medications.

The "discouraging" results point to the need to create "a healthier 'eat less, move more'" culture to help avoid obesity that contributes to diabetes, Dr. David Allen of the University of Wisconsin School of Medicine and Public Health wrote in an accompanying editorial.

"Trust me, I'm working on it," said the 19-year-old who lives in Commerce, Calif.

Kelsi Amer, a 14-year-old high school freshman from Patriot, Ind., knows how tough it is to keep her blood sugar from skyrocketing. Diagnosed at age 12, she takes metformin and gives herself insulin shots before school and at bedtime.

There are times when she has to miss class because she has to prick her finger to check her blood sugar or go with her mother to Cincinnati Children's Hospital Medical Center for check-ups.

"I try real hard and all of a sudden, I'm back to high blood sugar" levels, said Kelsi, who was not part of the research.

Like most insects, bed bugs gradually develop resistances to the various chemicals used against them, and they pass these resistances down to their offspring. The saying "what doesn't kill you makes you stronger" definitely applies to bed bugs. In the past, DDT was a highly effective pesticide used to exterminate bed bugs. However, since then bed bugs have developed resistances to DDT, as well as other chemical treatments that don't eliminate a bed bug population in one go.

In addition, chemical treatments also have a negative effect on the environment. Chemical treatments can cause children, pets, and even adults to become nauseated or ill. Chemical treatment is not recommended if you have young children or pets in the building. Also, it makes a canine bed bug inspection much more difficult to arrange. Most K9 inspection companies will be reluctant to inspect an apartment after it has gone through a chemical treatment. The reason for this is that the chemicals can not only interfere with the dog's ability to detect bed bugs, but also damage a dog's ability to detect bed bugs in the future.

Why are non-chemical treatments the most effective solution for bed bugs?

The main advantage is that bed bugs can't develop a resistance to non-chemical treatments such as heat or steam. High temperatures (120+ degrees F) are known to instantly kill bed bugs, and heat is not something that a bed bug can eventually become immune to. A heat treatment done ten years from now would still be just as effective as a heat treatment done today. The same can't be said for a chemical treatment.

A heat treatment is also very friendly to the environment. There won't be any issues with children or pets after a heat treatment, and a bed bug inspection dog can be brought back to clear the house within days.
